Detailed Terms of Products Agreement

This Terms of Products Agreement governs the use of Obrive Industries’ immersive technology platforms and solutions, including Obpark, Obnest, Obnavi, and Obmove.

1. Scope of Agreement

This agreement applies specifically to each product under Obrive Industries. By using our platforms, you agree to comply with these product-specific terms alongside our Master Service Agreement.

Product Usage Terms

a. Obpark (AR/MR Parking Navigation App)

  • Designed for parking management, navigation, and smart mobility.
  • Clients may deploy Obpark for internal operations, customer-facing services, or enterprise integration.
  • Restricted from repurposing for unrelated industries (e.g., reselling as a separate app).

b. Obnest (MR/VR Real Estate Navigation Platform)

  • Enables immersive property walkthroughs, architectural visualization, and client presentations.
  • Licensed for use by real estate developers, brokers, and property managers.
  • Clients must ensure uploaded 3D assets, floor plans, and content are lawfully owned/licensed.

c. Obnavi (Spatial AR Navigation System)

  • Provides indoor/outdoor AR navigation overlays for campuses, malls, airports, and manufacturing plants.
  • Permitted for use as part of enterprise systems or customer services.
  • Prohibited from use in applications involving public safety without prior Obrive approval.

d. Obmove (Motion/XR Interaction Platform)

  • Offers gesture-based controls, XR training, and motion simulations.
  • Licensed for training, education, and enterprise productivity use cases.
  • Not permitted for military or defense-related use unless explicitly contracted.

Licensing & Restrictions

  • Products are licensed, not sold.
  • Clients may not:
  • Reverse-engineer, disassemble, or clone Obrive platforms.
  • Resell or sublicense products without written consent.
  • Use the software in ways that violate laws or intellectual property rights.

Data & Content Responsibility

  • Clients retain ownership of content they upload (3D models, navigation data, designs, etc.).
  • Obrive is not liable for unauthorized or unlawful content uploaded by clients.
  • Obrive provides secure hosting, encryption, and backups but clients must maintain compliance with applicable data regulations.

Updates & Support

  • Obrive will provide software updates, patches, and bug fixes during the license period.
  • Product-specific support levels (response times, SLA commitments) are defined in the Service Agreement or SOW.
  • Major product upgrades may require additional licensing or subscription fees.

Termination & Suspension

  • Obrive may suspend or terminate product access if:
  • Terms are violated.
  • Payments are overdue.
  • The client uses the product in prohibited industries.
  • Upon termination, clients must discontinue use and remove Obrive software from devices/servers.

Liability & Warranty

  • Obrive products are provided “as is” with performance standards defined in specific contracts.
  • Obrive’s liability is limited to amounts paid in the prior 12 months for the specific product.
  • Obrive is not responsible for indirect damages such as business losses, data corruption, or third-party failures.

Governing Law & Disputes

  • This agreement is governed by the jurisdiction of Obrive’s headquarters.
  • Disputes will be resolved through arbitration or courts of law in the governing jurisdiction.
